Cyber Pornography: An Overview

Introduction
Cyber crimes means, crime done with the help of electronic gadgets like hacking, phishing[1], spamming[2]. With the development of electronic use, crimes also take shelter under internet. Various privacies are getting open up through the internet. We can find everything on the internet in just a few seconds. Through social media websites we can transfer information[3] one person to another in very less time and cyber increases the crime rate also, the offenders easily leak any personal information of somebody. The offences are broadly increased especially cyber crimes.

Porn today broadly available on internet. Pornography means “visualization of genitals organs” both male and females. It shows intimate course between men and women which generally done after their marriage The only purpose of pornographers[4] to arise fantasies in those persons who addicted to pornography and they succeed in this by the help of images, videos, tools and gadgets. Pornographers uses internet for the increasement selling, hires or distribution of their product. Pornography is illegal in India and watching videos and images and keeping the gadgets of sex is all illegal in India. Generally, pornography is nothing, it just a marketing of that objects through which sexual acts are done. In many businesses man uses it as their benefit, they fitted cameras in their hotels rooms and other places and afterall leak their videos also. In our country, sex is considered as private between men and women and yes, it is true also as well. Due to this privacy, sex education does not provide to children properly and parents do also not feel comfortable to give the education about this that’s why various fantasies arise between children and adults. This fantasy increases their curiosity about this and after that results shown increasement in the offences[5].

Is Cyber Increases the Sexual Violence?
Cyber crimes generates many crimes against Sexual Violence. Addicted persons get information from the internet and apply in their regular life which arises sexual violence badly. Sexual violence means sexual intercourse within coercion and without the consent of any of the partners. Mostly crimes against women even it cyber crimes. Pornographers uploaded nude images, videos. Nowadays “Boislocker room” is the best example of cybercrime against women. In that group, teenagers made a group on Instagram and threatened to girls for posting their nude photos and they also chatting about gang rape. This group girls terrified nowadays, many girls were affected from this. Recently, there is also a case against a Boy on Instagram, here a girl who defame[6] a Teenager boy, she said that boy sent her bad/dirty messages and also she sexually assaulted but actually not, there is no right in the eye of law to defame anyone even in any circumstances. The girl can be complaint against him but she defame him and as a result, the boy attempts suicide. Every time it is not necessary that males commit crime against women, in some cases women also indulge in cyber crimes and even actual crimes also.

Child Pornography is legal in India?
Child pornography is illegal in India. Under the Information Technology Act, 2000 and Indian Penal Code, 1860 protects a child against pornography. It is mentioned that, child is to considered below the “age of 18”. The internet is widely used by children, they would be restricted to watch any porn video. The abusers use the internet highly and they trying to indulged children in this, they show advertisements and creating chats on live channels due to this child getting indulge in it and also attracted towards paedophilia. Before watching any video, there is a restriction on them i.e. “below the age of 18 years restricted to watch this”.
 The Protection of Children from Sexual Offences ( POCSO) ACT, 2012
This is the Act made in 2012, in which children will be protected from sexual offences such as sexual assault, pornography, sexual harassment. The purpose of this Act is that below the age of 18 children will be protected from sexual offences. In this Act, cyber pornography will be covered and provisions made under this, following provisions are discussed below:
Section 13, of the POCSO ACT, 2012, states that media will be guilty or responsible for any child pornography, and children will be protected if he sexually harassed by cyber/media.
Section 14, of the POCSO ACT, 2012, states that punishment will be given to pornographer if he using a child as a pornographic purpose.

Laws in India
The punishments are described under IT Act, 2000: Section 67
1.    Three years of Imprisonment would be given to the offender or fine up to Rs. 5,00,000.
2.    Five years of Imprisonment if highly convicted or fine up to Rs. 10,00,000.
 Punishments under Indian Penal Code, 1860: Section 293
1.    Sale, hires or distribute of that objects through which sex acts can be done, Imprisonment for three years and fine up to Rs.2000.
2.    For subsequent conviction Imprisonment for seven years and a fine up to Rs. 5000.

Suggestions:
For the control on the pornography crime against children and adults, it is necessary to take an essential step, steps are followed:
·         It should be necessary that the education about sex made a part of higher education syllabus.
·         It should be necessary that parents also should talk about this in an educational manner.
·         Seminars, conferences should be organized about this.
·         Children also know about the harmful effects from the pornography.
·         The Legislative body should be banned on porn videos and make new strict laws on pornography that will lead to terror in the offender before doing anything wrong.
·         Children should be feel comfortable with their parents while they are talking about pornography.
Conclusion:
 In the world there are some places where prostitutes[7] would be considered as a right but in some places such as India prostitutes would be considered as wrong, through internet anyone can know about pornography and due to widely using of internet children also affected and it is significant for children about the unhealthy and side effects of sexual intercourse by the objects. Pornography content influence the youth for sexual desires and unhealthy relationships which was harmful. In 2018, the Indian Government banned 800 porn sites and videos, images sexual positions which was available on internet without restrictions. It is considered as parental control and guidance will vary significant and useful for children they played a role like a teacher, guider and everything. Parents should all focus on their children guidance. At the last but not least, the Government should make strict provisions and laws on pornography and also regulate strictly following the rules and regulation before taking any offensive step offender would think ten times, because it is necessary that the offender would be threatened and does not take a step against any of the citizen.
